License or not for selling LM clothing

    License or not for selling LM clothing

    Hi guys,

    I´m from South America and I´m wondering about if a need a license to sell LM clothing. 

    I bought recently quite a few LM clothes from the lesmillscollection page, now I will like to sell some of them (most of the clothes is for me) but the branch of LM in my country says that I cannot sell any unless I dont pay them for a license, because they have all the rights on LM brand.

    I asked some of my friend instructors, they say I on my right to sell LM clothing as this branch dont sell any, and if I bought clothes with my money why I couldnt sell it. They say that is illegal to sell videos or music, but not clothes.

    Please, someone tell me who is right.

    I dont know if my friends say this just because they want me to bring them clothes, but now that  I want to enjoy the team and became a BC instructor I dont want any troubles with the LM branch.

    Laws on this sort of thing can be quite variable from one country to another, so you'd need to the check the specifics locally.

    However, generally you are entitled to sell your own possessions (whatever they be) so long as there wasn't a specific clause prohibiting reselling/redistribution in the original sales contract, for example: as with the DVD sets. This is unlikely to be the case for clothing.

    I think what your local LM agent would have been worried about was you selling new LM merchandise on a commercial basis. If they own the redistribution rights in your country, then you'd be breaching their exclusivity. But having a one-off sale of your used clothing should not be of concern to them.

    hmmm, I don't think there's any issue if you're selling them as second hand. Anybody can sell on old goods without any fear of violation of copyright law (excepting les mills music). The restriction on selling of Les Mills music doesn't apply to the clothes.

    However, if you're buying the clothes in bulk and attempting to sell them on to make money, then this verges on breeching the licence required to sell new LM clothing in bulk.

    I would contact LMI or your agent to clarify.

    Ok, I got it, so they are right because the clothes is new. So I will talking to them for the license conditions as my friends like to buy me some. The branch let me sell Bodysystems clothes but not LM clothes, however I have not a shop or a big business I just bought more to get further discounts, but I havent sell anything yet, just BS ones.
